1. Acceptance of Terms

By accessing or using NISTBox™, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

2. Description of Service

NISTBox™ provides cybersecurity visibility, monitoring, assessment, and related services aligned with industry standards (including NIST-based frameworks) for informational and operational purposes.

The Service is intended to help users understand and improve their own security posture.

3. Authorized Use Only (CRITICAL SECTION)

You agree that:

  • You will use the Service only for systems, domains, networks, and assets that you own or are explicitly authorized to assess.
  • You will not use the Service to scan, monitor, probe, or assess any third party without their explicit written authorization.
  • You will not use the Service for:
    • Unauthorized security testing
    • Reconnaissance of third-party systems
    • Competitive intelligence gathering
    • Any unlawful or unethical activity

Any unauthorized use is strictly prohibited and may result in immediate termination and legal action.

4. User Responsibility

You are solely responsible for:

  • Ensuring you have proper authorization to use the Service on any asset
  • All activities conducted under your account
  • Compliance with all applicable laws and regulations

ControlledLogic does not verify ownership or authorization of assets submitted to the Service.

5. No Guarantee of Security

The Service:

  • Does not guarantee prevention of security incidents, breaches, or attacks
  • Does not constitute a complete security solution
  • May not identify all vulnerabilities or threats

You acknowledge that cybersecurity involves inherent risks and no system is completely secure.

6. Advisory Nature of Service

All outputs, reports, alerts, and recommendations:

  • Are provided for informational purposes only
  • Do not constitute legal, compliance, or security guarantees
  • Should not be solely relied upon for critical decisions

7. Transparency & Public Display

If your platform includes public-facing trust indicators or profiles:

  • You control whether your security posture or status is publicly displayed
  • ControlledLogic does not guarantee accuracy of third-party interpretation
  • Public indicators are high-level summaries, not full security disclosures

8. Limitation of Liability

To the fullest extent permitted by law:

ControlledLogic shall not be liable for:

  • Any direct, indirect, incidental, or consequential damages
  • Data loss, business interruption, or financial loss
  • Security breaches, cyberattacks, or system compromises
  • Misuse of the Service by users or third parties

Your use of the Service is at your own risk.

9. Indemnification

You agree to indemnify and hold harmless ControlledLogic from any claims, damages, or liabilities arising from:

  • Your misuse of the Service
  • Unauthorized scanning or monitoring of third parties
  • Violation of laws or these Terms

10. Service Availability

We do not guarantee:

  • Continuous availability
  • Error-free operation
  • Immediate detection or response

The Service may be modified, suspended, or discontinued at any time.

11. Pricing & Services Disclaimer

  • Security services (SOC, IR, monitoring, etc.) are scoped based on available information
  • Pricing may vary depending on complexity and environment
  • No guarantee is made that services will fully mitigate all risks

12. No Professional Warranty

ControlledLogic provides services "as is" without warranties of any kind, including:

  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or completeness

13. Termination

We may suspend or terminate your access if:

  • You violate these Terms
  • You misuse the Service
  • You engage in unauthorized or unlawful activity

14. Compliance with Laws

You agree to comply with all applicable:

  • Cybersecurity laws
  • Privacy regulations
  • Data protection requirements

15. Governing Law

These Terms shall be governed by the laws of the State of Ohio, without regard to conflict of law principles.
